Standard MAD Web Terms and Conditions
Unless otherwise agreed in writing, all orders are accepted subject to the following terms and
conditions. Any special conditions printed on the customers order will not be accepted if they are at
variance with our own.
Domain Names
The title of the domain names ordered remain the property of MAD Web™ until payment in full has
been received. Title will then pass to the client upon cleared funds for the registration period, renewal
fees when due are required in advance otherwise the domain name will lapse.
Once ordered domain names cannot be altered and no refunds are available, (be very careful in the
spelling of domain name requests as no responsibility can be undertaken for errors).
Should you wish to transfer out your domain name at any time there may be a small administration
charge to pay before the process is activated.
Prices
All prices quoted are subject to alteration at any time without notice, unless made firm for an agreed
period, and whilst every endeavour is made to ensure accuracy, no responsibility is accepted for any
error or omission.
Specific quotes are available in writing with guaranteed costs valid for a minimum of thirty days from
the date the estimate is submitted.
Deposit Payment
No refunds can be accepted for deposit payments. We can upgrade hosting packages but not
downgrade. Once orders have been placed, all payments are for one or two year periods as stated
on the customers invoice. MAD Web™ reserve the right to take down from the public domain any
web site where an element remains unpaid. All domain names and hosting packages must be paid
for in advance. Domain names two years with hosting one year or two years in advance, unless
specified.
No account will be activated until cleared funds have been received.
Webspace
C-panel and FTP access along with all necessary passwords etc will also be forwarded by email. It
is advisable for clients to follow all instructions issued by MAD Web™ to ensure that their webspace
remains intact and available to the public domain at all times. MAD Web™ may charge an additional
fee should it be necessary to rectify a problem caused by the client which would become payable in
advance.
General Terms
We do not allow Warez, illegal MP3 Sites or IRC Bots.
Adult sites are permitted with relevant public warnings to protect minors from gaining free access to
any pornographic material.
You may not store more data in your account than your allotted server space.
Your server (inc FTP access) is for your personal use only. You must not divulge the password to
any other person, and you should take reasonable precautions to ensure that it is not discovered by
other people.
Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an
independent backup of all data stored on your server.
You may not run server processes (eg. talkers/IRC Bots) from your virtual server.
We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or
removal of services.
When your account is closed, all files (including web pages, etc.) will be deleted.
We reserve the right to cancel your account at any time without notice.
We reserve the right to amend and update these Terms and Conditions at any time without notice.
To protect your privacy we never distribute your name or e-mail address to any third parties.
Users must not participate in any form of unsolicited bulk e-mailing or spam.
By logging into your account, or uploading files to it, you are indicating your acceptance of these
Terms and Conditions.
Refunds
If you take out one of yearly packages we expect you to commit for this period of time. If you cancel
your account within your service period then MAD Web™ will not make any refunds on any unused
portions of your account. While we do not offer refunds for prorated service you have no obligation to
continue using our service. Although your domain name registration will continue with your new host
until the expired date.
Control Panel
Any attempt to use the online Control Panel for purposes other than it's intended use will result in
your account being terminated.
Bandwidth
If your bandwidth reaches the points where it has an adverse affect on other clients we reserve the
right to disable your site until you can reduce your bandwidth usage.
* Each server includes a nominated amount of bandwidth, if you use more than this amount then you
agree to pay for this bandwidth at a rate of 10p (ten pence) per 1 MB.
Web Page
Commercial use of web and ftp space is permitted.
You will be responsible for the content of your pages, including obtaining the legal permission for
any works they include and ensuring that the contents of these pages do not violate UK law.
You will be held responsible for and accept responsibility for any defamatory, confidential, secret or
other proprietary material available via your page(s).
We reserve the right for any site to show that MAD Web™ servers power any website that resides
on our servers ie ‘POWERED by MAD Web™’ (in text format or by using one of our buttons), these
should also be linked in hyperlink format to either www.madwebdesign.co.uk, any other statement
appertaining to ‘POWERED by’ will require written approval from MAD Web™ before being
published.
We reserve the right to remove material deemed inappropriate from your web pages should the need
arise, without prior notice.
OVERDUE PAYMENTS
Overdue payments may result in your account being suspended with a £25 re-connection fee being
imposed prior to re-connection. Please ensure your payments reach us in good time to clear before
your renewal date. Access to domain names and website files will be withheld until overdue
accounts are settled in full.
Web Design
MAD Web™ will start work on the build of a clients web site once either a deposit or full payment
has been agreed and cleared funds are available. Should there be any outstanding balance for either
web site build or maintenance MAD Web™ reserves the right to request MAD Web™ to suspend
the clients website until the outstanding balance has been settled in full.
Payment terms we accept as follows:
Visa/Mastercard (using PayPal services)
BACCS Tansfer (details supplied upon request)
Cash with order by prior arrangement
* We reserve the right to suspend an account that has not paid cleared funds by end of business on
a Friday if the renewal is due on a Saturday or Sunday.
